How Long Do I Have to File a Personal Injury Claim?
A statute of limitations is the law that sets the deadline for filing a personal injury action to recover compensation for damages. If you miss your filing deadline, you will not be able to seek compensation.
Louisiana recently extended its filing deadline for most personal injury claims from one year to two years. Louisiana Civil Code Article 3493.1 became effective July 1, 2024.Â
Under this new law, if your accident occurred prior to July 1, 2024, you only have one year to file a claim. If your accident happened on or after July 1, 2024, you have two years to file a claim.
If you lost a loved one due to another party’s fault, you may be entitled to file a Louisiana wrongful death action. However, the deadline for filing a wrongful death claim is only one year from the date of the decedent’s death.Â
