What is a Wrongful Death Action?
Louisiana Civil Code Article 2315.2 A. states:
“If a person dies due to the fault of another, suit may be brought by the following persons to recover damages which they sustained as a result of the death:
- The surviving spouse and child or children of the deceased, or either the spouse or the child or children.
- The surviving father and mother of the deceased, or either of them if he left no spouse or child surviving.
- The surviving brothers and sisters of the deceased, or any of them, if he left no spouse, child, or parent surviving.
- The surviving grandfathers and grandmothers of the deceased, or any of them, if he left no spouse, child, parent, or sibling surviving.”
So, a wrongful death action seeks compensation for the damages sustained by the deceased’s surviving loved ones. Only those persons outlined in the statute can seek compensation for their losses.
If the deceased person suffered compensable injuries before dying, their family members may also be entitled to bring a survival action.
A survival action is provided for in Louisiana Civil Code Article 2315.1. With a survival action claim, the loved ones of the deceased or the deceased’s succession representative can bring a claim to recover damages sustained by the deceased person before their death.
If the deceased person could have brought a personal injury suit had they survived, that claim is inherited by their loved ones when they die.
How Long Do I Have To File A Wrongful Death Claim?
Both wrongful death actions and survival actions have a statute of limitations of one year.
Note that you must bring the claim within one year from the death of the deceased, which is not necessarily the date of the accident that ultimately caused their death.
What Damages Can I Recover in a Prairieville Wrongful Death Action?
A wrongful death action seeks compensation for the damages suffered by the loved ones of the deceased person. The type of damages available in a wrongful death action may include:
- Funeral and burial expenses.
- Loss of financial support and income the deceased would have provided.
- Loss of consortium, love, guidance, and companionship.
- Mental and emotional distress.
These damages are in addition to any damages you may be able to recover in a survival action. Survival action damages may include:
- The decedent’s medical expenses and other expenses incurred due to their injuries.
- The lost wages of the decedent before their death.
- The decedent’s pain and suffering from their injuries.
- Any other damages the decedent could have recovered had they survived.
